Terms of Service

These Terms of Service govern your use of Main Street Audit ("the Service"), operated by Marketing Main Street LLC ("we," "us," or "our"), located in Stuart, Iowa. By using the Service you agree to these terms. If you do not agree, do not use the Service.

1. The Service

Main Street Audit provides automated website scanning tools that analyze publicly accessible websites for technical issues including accessibility barriers, page speed performance, and SEO factors. Results are generated by automated software and are delivered on screen and/or by email.

2. Accessibility Scanning -- Important Limitations

READ THIS SECTION. It directly affects how you may use and represent our accessibility scan results.

Our accessibility scanner uses axe-core automated testing against the WCAG 2.1 Level AA ruleset. You expressly acknowledge and agree to the following:

  • Automated testing detects approximately 30-40% of real accessibility barriers. A passing score or absence of flagged issues does NOT mean your website is accessible to all users.
  • Results from our scanner do NOT constitute a certification of accessibility or legal compliance with the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, WCAG 2.0, WCAG 2.1, WCAG 2.2, or any other legal standard at any conformance level.
  • Our reports document automated scanning work performed, not a legal determination of compliance.
  • You may NOT represent our scan results as proof of ADA compliance, legal accessibility, or certification of any kind to any third party, regulator, or in any legal proceeding.
  • Remediation of flagged items does not guarantee freedom from legal claims related to web accessibility.

For legal compliance assurance, consult a qualified accessibility specialist and/or legal counsel.

3. General Disclaimer for All Tools

All results generated by Main Street Audit -- including but not limited to page speed scores, SEO analysis, accessibility findings, and technical recommendations -- are informational only. We make no representation or warranty that:

  • Improved scores or passing results will result in higher search engine rankings, increased website traffic, or any specific business outcome
  • Our results are complete, accurate, or free from error
  • Implementing our recommendations will achieve any particular result

SEO and accessibility are ongoing practices that require continuous effort. No single audit represents a permanent state of any website.

4. Payments and Refunds

Paid reports are delivered electronically upon completion of payment. Because reports are generated and delivered immediately, all sales are final. We do not offer refunds except in cases where the scan failed to complete due to a technical error on our end, in which case you may request a refund or a re-scan within 7 days of purchase by emailing [email protected].

Payments are processed by Stripe. We do not store your payment card information.

5. Acceptable Use

You may only use this Service to scan websites you own or have explicit permission to scan. You may not use this Service to:

  • Scan websites without authorization from the site owner
  • Attempt to circumvent rate limits or abuse the free tier
  • Resell or redistribute our reports without our written permission
  • Use scan results to make false claims about a website's compliance status

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETING MAIN STREET LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

7. Intellectual Property

Report content generated by our tools based on your website data belongs to you. The underlying software, design, and methodology of Main Street Audit belong to Marketing Main Street LLC.

8. Privacy

We collect the URL you submit for scanning and your email address if provided. We use your email to deliver your report and, if you opt in, to send occasional product updates. We do not sell your information to third parties. Scan results are stored for up to 30 days and then deleted.

9. Changes to These Terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms. The "last updated" date at the top of this page reflects the most recent revision.

10. Governing Law

These terms are governed by the laws of the State of Iowa, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Guthrie County, Iowa.
